NameSpace - Legal

These Terms & Conditions ("Terms") govern your use of the NameSpace application ("the App") developed and published by Hannes Oud ("the Developer"). By downloading or using the App you agree to be bound by these Terms. If you do not agree, do not download or use the App.
The Developer grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on macOS devices that you own or control, solely for your personal, non-commercial purposes.

The App and all associated intellectual property rights remain the sole property of the Developer. Nothing in these Terms transfers any ownership rights to you.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
The App uses private macOS system APIs that are not publicly documented by Apple. These APIs may change or be removed in any macOS update without notice, which could cause the App to malfunction or stop working entirely. The Developer makes no guarantee of continued functionality across macOS versions.
The Developer may terminate or suspend your right to use the App at any time, for any reason, without notice. Upon termination you must cease all use of the App and destroy any copies in your possession.
The Developer reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the App after any changes constitutes acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.
Your privacy is important. This Privacy Policy explains what information NameSpace collects and how it is used.
NameSpace does not collect, transmit, store, or share any personal information or usage data. The App runs entirely on your device. No data of any kind is sent to the Developer or any third party.
The App stores your space names and window preferences locally on your Mac using standard macOS mechanisms (such as UserDefaults). This data never leaves your device.
The App uses Sparkle to check for software updates. When checking for updates, your device may contact the Developer's server to download the appcast feed. This connection may result in standard web server logs (such as IP addresses and request timestamps) being recorded by the hosting provider. The Developer does not use these logs for tracking or identification purposes.
NameSpace contains no analytics, telemetry, advertising, or tracking code of any kind.
No user information is shared with any third party, because no user information is collected in the first place.
The App does not knowingly collect any personal information from anyone, including children under the age of 16.
The Developer may update this Privacy Policy from time to time. Changes will be posted on this page with a revised effective date.
